Officer's estranged wife faces charges

The estranged wife of a Henry County police detective forced a 13-year-old girl to flash her breasts and photographed her using a male friend's cell phone, according to testimony Friday. The woman also allowed the teen to smoke after selling her a pack of cigarettes for $5 which was given to her for showing her breasts.

Katherine Marie "Kathy" Ferguson, 34, of Amber Chase, McDonough, will have to appear before a Henry Superior Court judge in order to get a bond, said Magistrate Robert Godwin following a probable cause hearing Friday morning.

Godwin found probable cause to charge Ferguson with violating a temporary protective order, enticing a child for indecent purposes, aggravated stalking and contributing to the delinquency of a minor. She is being held in the Henry County Jail.

Henry police Detective Rene Swanson said warrants have been taken for Ferguson's male friend, William Ernest Bain, 41, of Lake Court Drive, McDonough. Bain was arrested Friday at 10:10 a.m. for enticing a child for indecent purposes and sexual exploitation of a child, according to Henry County Jail records.

Bain was arrested Wednesday for possession of marijuana and possession of dangerous drugs and was released on a $6,100 bond on Thursday. He got a $10,000 bond on the new charges.

Ferguson is estranged from Henry Police Detective Allan Ferguson, who attended Friday's hearing. She addressed him when the hearing ended.

"Allan, if I sign the divorce papers, will you drop the charges?" she said as she was led back to jail.

"No," said Ferguson as he walked out of the courtroom.

Godwin told her Ferguson has no control over whether or not charges go forward and asked her court-appointed attorney, Gary Bowman, to explain to her the state is pursuing prosecution, not her estranged husband.

Swanson testified that an intoxicated Kathy Ferguson took the girl to Bain's home last month. Once there, the two adults continued drinking, said Swanson. Bain allowed the girl to drive his Chevrolet Blazer through his neighborhood, the investigation revealed, and then asked her to "flash" her breasts to him as payment.

"He told her she owed him for letting her drive," said Swanson. "To show him her boobies. When she wouldn't, Ferguson told her to do it and she did."

Bain then reportedly said he'd like to have a photo of the girl's breasts on his cell phone camera but again the girl declined, Swanson testified, even when Bain offered her $5 to do it.

"Ferguson took her into the kitchen, lifted up her shirt and took a picture of her breasts," Swanson said.

Swanson said when Bain gave her $5 the girl asked Ferguson if it was enough money to buy a pack of cigarettes.

"Ferguson told her it was and she drove the girl to her house where she sold her a pack of cigarettes for $5," said Swanson.

Back at Bain's home, Ferguson allowed the girl to smoke. Also during the evening at Bain's home, Swanson said Bain grabbed the girl's buttocks twice.

A search warrant of Bain's basement apartment turned up the cell phone, which still held the girl's photo, Swanson testified. Officers also reportedly found marijuana growing and drugs at the Bain home.

Police were alerted to the events of that night by the girl's baby-sitter, said Swanson.

Only a Superior Court judge can set a bond on an aggravated stalking charge.
