A 38-year-old man has been indicted on charges he stabbed his wife to death while the couple's children cowered in a back room.

Demetrio Patricio Rose reportedly told his attorney he doesn't remember anything from the night Ani H. Rose was stabbed to death. Clayton County Police said he confessed to killing his wife when they arrived at the door of the Ellenwood home on Sept. 16. Ani Rose was found dead on the kitchen floor. A blood-covered knife was in the sink.

A Clayton County grand jury handed down an indictment Wednesday, saying Demetrio Rose "unlawfully and with malice aforethought did cause the death of Ani Rose, a human being, by stabbing her with a certain knife."

The grand jury indicted Demetrio Rose on charges of aggravated assault, malice murder, felony murder, weapons possession and cruelty to children. He will undergo a psychological examination before he goes to trial, but prosecutors say he "wasn't howling at the moon," and say the case is open-and-shut. He has not received bond.

The couple was in the middle of a divorce when Ani Rose, a 36-year-old native of Germany, returned from a short vacation with her extended family in Canada, and found her husband in the family home.

Ani Rose had filed for a protective order against her husband, but it had been rejected by a county magistrate judge. Ani Rose and her lawyer submitted to evidence of physical abuse to the court, photographs of bruises on her arms and body. But the pictures did not show her face, and the judge did not consider the evidence sufficient for a protective order. An appeal was scheduled to take place about a month after Ani Rose was murdered.

Court and police records show reports of domestic disputes dating back two years before the murder.

At one point, Demetrio Rose filed for divorce against his wife, though he later dropped the petition. At another point, she went to police and said she feared he would flee the country, maybe returning to his native Panama, with their children.

The couple's children -- a 14-year-old and a 9-year-old -- are reportedly staying with Demetrio Rose's sister.

Demetrio Rose's next court date has not yet been set.
