A Rockdale man arrested in December for alleged illegal gambling told a Clayton County judge Tuesday he wants his seized property returned.
But Clayton District Attorney Tracy Graham Lawson said the feds have taken official possession of items taken from the home of Larry Lee Simmons.
"I've been assured that federal charges are coming," she told Superior Court Judge Albert Collier. "The local charges will go away if the federal charges are filed. All his property has been turned over to the feds, that's my understanding."
Defense attorney Alan Begner was surprised to hear the latest development, saying it is the first time he'd been made aware that local charges would be dropped.
"I would ask that the authority to turn over my client's property to the feds, be produced and made part of the record," Begner said.
Collier agreed and ordered that documentation be produced within 10 days.
