JONESBORO — An Arizona trucker was arrested Sunday night in Forest Park for allegedly having sex with an underage prostitute, according to warrants issued to police.
Jack Brewer Jr., 51, of Ashdown, Ariz., was charged with pandering for prostitution, child molestation and enticing a child for indecent purposes.
However, due to a technicality, Clayton County Magistrate Court Chief Judge Daphne Walker told Brewer during his first appearance hearing Tuesday that she was dropping the charges.
“I’m dismissing the case as written because the officer didn’t include the name of the victim or her date of birth,” said Walker. “The warrant says in one place she was a person under 18 and in another that she’s 15 but there’s no date of birth.”
Walker said police officers have 48 hours to file new warrants with complete information for ones with incomplete information.
Brewer made his first court appearance Monday afternoon but it was continued while Walker made inquiries to police about her concerns.
The warrants allege that Brewer solicited a 15-year-old prostitute about 11 p.m. Sunday. Forest Park police allege Brewer took the girl into the cab of his 2011 International Commercial truck for the purposes of engaging in sexual intercourse for money.
Brewer was not off the hook, however. Walker told Brewer and his attorney, Thomas Barton, that the arresting officer was out of town but a second officer who responded to the arrest would re-issue the same charges. Late Tuesday afternoon, a new set of the same charges were filed, according to Clayton Magistrate Court.
Walker set a total bond of $55,000 on the three charges.
“I don’t expect to change those bond amounts,” she said.
Brewer’s first appearance was continued a second time, until this afternoon.
“Three days in a row for a first appearance on one case,” said Barton. “I don’t think that’s ever happened to me before.”
At press time, Brewer was still in the Clayton County Jail.
