Ecolab is'nt that powerful!!!

Current CasesMcInnis v. Ecolab, Inc., No. 11-cv-01296 (D.Minn.)

This is a putative class action lawsuit that is currently pending in St. Paul, MN on behalf of a class of Field Service Specialists who work or worked for Ecolab's EcoSure division. We have alleged that Ecolab violated the Fair Labor Standards Act and the Employee Retirement Income Security Act by failing to pay the Field Service Specialists for all the hours they worked, and by treating them as “independent contractors” when, in fact, they should have been classified as “employees” and should have had all the rights and benefits that other Ecolab employees receive.

The plaintiff, Suzette McInnis, and Ecolab have agreed to a classwide settlement, which the court has approved. You can read the court's opinion of the settlement here. If you worked as a Field Service Specialist for EcoSure between January 1, 2009 and January 31, 2012 and had at least one work week in which you had 20 or more reported Service Hours, you may be entitled to participate in the settlement, and you will be sent a Notice of Settlement via regular mail and email by May 15, 2012. If you did not receive a Notice of Settlement, you may download one here. The Notice of Settlement explains the terms of the settlement, how the settlement funds will be distributed, and how your legal rights will be affected by participating or not participating in the settlement.

In order to participate in the settlement, you must fill out and return a Consent Form by June 15, 2012. The Consent Form will be mailed and emailed to you by May 15, 2012 along with the Notice of Settlement. If you did not receive a Consent Form, you can download one here.
