By Order of the Court, notice is hereby given that a Petition and Declaration of Taking to acquire a right-of-way interest in certain property by condemnation was filed by Clayton County on June 10, 2016, seeking to condemn the following property and property rights for public right-of-way expansion purposes.
REQUIRED RIGHT OF WAY
All that tract or parcel of land lying and being in Land Lot 73 of the 13th Land District of Clayton County, Georgia, being more particularly described as follows:
COMMENCING at the intersection of the eastern right of way of Derrick Jones Rd (RW Varies) with the southern right of way line of Southridge Pkwy (RW Varies); thence northwesterly along the southerly right of way line of Southridge Pkwy a distance of 1,067.64' to a point, this being the TRUE POINT OF BEGINNING;
Thence leaving said right of way S42deg.17'55"E a distance of 61.31' to a point;
Thence N82deg.21'14"W a distance of 67.74' to a point;
Thence N35deg.04'38"W a distance of 51.16' to a point on said right of way;
Thence continuing along said right of way on a curve to the right (said curve having a chord distance of 55.55' on a bearing of S84deg.17'02"E, a radius of 459.00' and a length of 55.59') to a point, this being the TRUE POINT OF BEGINNING.
Said required Right of Way for Parcel #3, containing 2,443.20 sq. ft. (0.056 acres) more or less.
All according to the attached plans titled Southridge PKWY at Sullivan Creek; Bridge Repair Program Site No. 30, Required Right of Way as drawn by Clayton County Department of Transportation and Development, dated April 2, 2014; Sheet No. 1 of 1; which plans are incorporated herein by reference and made a part of this description.

EASEMENT
All that tract or parcel of land lying and being in Land Lot 73 of the 13th Land District of Clayton County, Georgia, being more particularly described as follows:
COMMENCING at the intersection of the eastern right of way of Derrick Jones Rd (RW Varies) with the southern right of way line of Southridge Pkwy (RW Varies); thence northwesterly along the southerly right of way line of Southridge Pkwy a distance of 1,123.23' to a point, this being the TRUE POINT OF BEGINNING;
Thence leaving said right of way S35deg.04'38"E a distance of 51.16' to a point;
Thence S82deg.21'14"E a distance of 67.74' to a point;
Thence S42deg.17'55"E a distance of 33.44' to a point;
Thence N81deg.31'10"W a distance of 102.14' to a point;
Thence N34deg.48'28"W a distance of 74.12' to a point on said right of way;
Thence along said right of way on a curve to the right (said curve having a chord distance of 24.30' on a bearing of S89deg.16'12"E, a radius of 459.00' and a length of 24.30') to a point, this being the TRUE POINT OF BEGINNING.
Said Permanent Access Easement contains 3,006.70 sq. ft. (0.069 acres) more or less.
All according to the attached plans titled Southridge PKWY at Sullivan Creek; Bridge Repair Program Site No. 30, Permanent Access Easement as drawn by Clayton County Department of Transportation and Development, dated April 2, 2014; Sheet No. 1 of 1; which plans are incorporated herein by reference and made a part of this description.
You are hereby notified that an Order has been signed by the Court requiring all persons known or believed to be the owners, or having an interest in or claims against the Property as well as all others claiming any title to or interest in the Property, or in the funds on deposit with the Clerk of Court to file with the Court a Notice of Appeal and make known their claims, the same to be in writing and made a part of the record in the proceedings.
The parties known to have an interest are Prologis Targeted U.S. Logistics Fund, L.P., f/k/a AMB U.S. Logistics Fund, L.P., f/k/a AMB Institutional Alliance Fund, III, L.P., Owner; Southridge Business Center Property Owners Association, Inc.; Central Georgia Transmission Company; Georgia Utilities Company; Clayton County Water Authority; AT&T Corp., as successor to Southern Bell Telephone and Telegraph Company; Georgia Power Company; John W. Rooker; Osram Sylvania Inc. f/k/a GTE Products Corporation; Nippon Express USA, Inc.; and Terry L. Baskin, Clayton County Tax Commissioner.
