NOTICE OF SALE UNDER POWER Under and by virtue of the power of sale in that certain Deed to Secure Debt from Michael Moore and Sonja Moore to Thomas N. Carder, found at Clayton County Deed Book 2112 Page 144 and dated July 29, 1994 in the principal amount of $67,500.00, and assigned to Serpentor Holdings, LLC at Clayton County Deed Book 11557 Page 263 with attorneys' fees and costs as specified therein, and because of the default in the payment of indebtedness secured by said Security Deed, Serpentor Holdings, LLC having declared the entire amount of said indebtedness due and payable pursuant to the power of sale contained in said Security Deed, will on the first Tuesday of August 2019, during the legal hours of sale, at the courthouse door of Clayton County, Georgia, sell at public outcry to the highest bidder for cash the following property described in the said deed to wit: All that tract or parcel of land, with house and all other improvements located thereon, lying and being in Land Lot 235 of the 13th Land District of Clayton County, Georgia, being Lot 40, Block H, Wexwood Subdivision, Unit Four, as per plat recorded in Plat Book 17, Page 129, Clayton County, Georgia Records. The description of said property as contained on said plat is hereby incorporated herein and by referenced made a part hereof. That property known as 8144 Englewood Trail Riverdale, Georgia 30274 according to the present system of numbering homes in Clayton County, Georgia and having tax parcel identification number 13235A-I006. Carolina D. Bryant is the individual who has full authority to negotiate, amend and modify all terms of the security deed. The property is being sold subject to: (a) any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable); (b) unpaid water or sewage bills that constitute a lien against the property whether due and payable or not yet due and payable and which may not be of record; (c) the right of redemption of any taxing authority; (d) any matters which might be disclosed by an accurate survey and inspection of the property, and any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The sale is being conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Banruptcy Code and (2) final confirmation and audit of the loan with the holder of the security deed. Pursuant to O.C.G.A. § 9-13-172.1, which allows for certain procedures regarding the rescission of judicial and non-judicial sales in the State of Georgia, the Deed Under Power and other foreclosure documents may not be provided until final confirmation and audit of the status of the loan as provided immediately above. Notice has been given of this foreclosure and of the intention to collect attorneys' fees in accordance with the terms of the note at least 30 days prior to the scheduled sale by writing, sent certified return receipt mail and regular mail to the debtor.
