NOTICE OF SEIZURE OF PERSONAL PROPERTY VALUED AT $25,000.00 OR LESS PURSUANT TO O.C.G.A. § 9-16-11 DA Notice of Seizure # DANOS 2019-102 Date Notice Posted 09/23/19 Seizing Police Agency/Case # Clayton County Police Department—Drug Task Force—Airport Interdiction Unit/ 19046142 Description of the Property: Twenty-Four Thousand Five Hundred Dollars ($24,500.00) US Currency Date of Seizure: 08/28/19 Place of Seizure: 4400 N. Terminal Parkway, Clayton County, Forest Park, GA 30297 Conduct Giving Rise to Forfeiture: On or about 08/28/19, Stephan Letae McMillian was in possession and control of the above described currency, which was being used and/or was intended to be used to facilitate an illegal transaction(s) for the purchase and/or sale of a controlled substance and/or marijuana in violation of O.C.G.A. §16-13-30, §16-13-31, and §16-13-33; and/or was attempting and/or conspiring to violate O.C.G.A. §16-13-30 an/or §16-13-31 in violation of O.C.G.A. §16-13-33; and/or was in possession and control of the above-described currency with which she intended to purchase marijuana outside the State of Georgia to be shipped back to the State of Georgia in violation of O.C.G.A. §1613-30, §16-13-31, and/or 16-13-33 of the Georgia Controlled Substances Act, Said seizure was made based on the existence of probable cause to believe that the property is subject to forfeiture subsequent to a consent search of Stephan Letae McMillian's baggage during which officers located the above-described currency on which a certified narcotics K-9 positively alerted to the odor of narcotics. McMillian provided dishonest and/or inconsistent statement regarding how he came into possession of the currency, his employment status and how he is paid, his trip itinerary, and/or other statements regarding his intended use of the currency. Furthermore, McMillian has a history of drug related offenses. Alleged Violation of Law: Violation of Georgia Controlled Substances Act-O.C.G.A. § 16-13-30 TO: ANY AND ALL OWNERS OR INTEREST HOLDERS OF THE SEIZED PROPERTY TAKE NOTICE of the above and further notice is hereby given that the owner or interest holder of the above-described seized property has thirty (30) days within which a claim must be served on the state attorney whose name and address is: Tiffany Boulware Pleasant Senior Assistant District Attorney District Attorney's Office Clayton Judicial Circuit 9151 Tara Boulevard, 4th Floor Jonesboro, GA 30236 Said claim must be served by certified mail or statutory overnight delivery, return receipt requested, and such claim shall be signed by the owner or interest holder and shall provide: (A) The name of the claimant; (B) The address at which the claimant resides; (C) A description of the claimant's interest in the property; (D) A description of the circumstances of the claimant's obtaining an interest in the property and, to the best of the claimant's knowledge, the date the claimant obtained the interest and the name of the person or entity that transferred the interest to the claimant; (E) The nature of the relationship between the claimant and the person who possessed the property at the time of the seizure; (F) A copy of any documentation in the claimant's possession supporting his or her claim; and (G) Any additional facts supporting his or her claim.
