NOTICE OF SEIZURE OF PERSONAL PROPERTY VALUED AT $25,000.00 OR LESS PURSUANT TO O.C.G.A. § 9-16-11(a) DA Notice of Seizure # DANOS 2021-052; 21CLT02934 Date Notice Posted 7/19/2021 Seizing Police Agency/Case # Clayton County Police Department Case No. 21031901 Description of the Property: Ten Thousand One Hundred Six and 00/100 Dollars ($10,106.00) U.S. Currency; and Glock 9mm handgun, black in color (Serial No. DDT802) Date of Seizure: June 2, 2021 Place of Seizure: At or about 6433 Tara Blvd., Jonesboro, Clayton County, GA 30236 Conduct Giving Rise to Forfeiture: On or about June 2, 2021, Justice Falls and/or Anthony Weaver was/were allegedly in possession of and/or did knowingly display a false, fictitious, fraudulent, or altered identification document, to wit: a drivers license and social security card bearing the name Michael Kato James for the purposes of purchasing a firearm at Arrowhead Pawn. The drivers license number returned to an individual other than Michael Kato James. The social security card bore seals of the State of Georgia and Social Security Administration but contained a number that has not been issued by the Social Security Administration. Previously, on or about May 21, 2021, Falls used the drivers license of Michael Kato James to purchase the seized firearm. The seized property was used or intended to be used in a manner to facilitate a violation of O.C.G.A. § 16-9-4 and/or the seized property is proceeds from a violation of O.C.G.A. § 16-9-4. Alleged Violation of Law: Violations of O.C.G.A. § 16-9-4(b)(1) Possession of a False/Fictitious/Fraudulent/Altered Identification Document; Display of a False/Fictitious/Fraudulent/Altered Identification Document; Use of a False/Fictitious/Fraudulent/Altered Identification Document TO: ANY AND ALL OWNERS OR INTEREST HOLDERS OF THE SEIZED PROPERTY TAKE NOTICE of the above and further notice is hereby given that the owner or interest holder of the above-described seized property has thirty (30) days within which a claim must be served on the state attorney whose name and address is: Karen S. Barbour Assistant District Attorney District Attorney's Office Clayton Judicial Circuit 9151 Tara Boulevard, 4th Floor Jonesboro, GA 30236 Said claim must be served by certified mail or statutory overnight delivery, return receipt requested, and such claim shall be signed by the owner or interest holder and shall provide: (A) The name of the claimant; (B) The address at which the claimant resides; (C) A description of the claimant's interest in the property; (D) A description of the circumstances of the claimant's obtaining an interest in the property and, to the best of the claimant's knowledge, the date the claimant obtained the interest and the name of the person or entity that transferred the interest to the claimant; (E) The nature of the relationship between the claimant and the person who possessed the property at the time of the seizure; (F) A copy of any documentation in the claimant's possession supporting his or her claim; and (G) Any additional facts supporting his or her claim.
